Merilin Yemek – TERMS OF USE Version: 1.2.0 | Effective: 2 Haziran 2026 1. PARTIES AND DEFINITIONS 1.1. Service Provider The Platform is provided under the Merilin Yemek brand by the Service Provider, based at İzmir, Türkiye. The Service Provider is an individual tax resident in Türkiye and is not an incorporated legal entity. 1.2. These Terms (“Agreement”) govern use of the Platform (“Platform”, “we”) by any individual or business (“User”, “you”). 1.3. “Buyer”: end user discovering nearby businesses on the map. 1.4. “Seller / Business”: business owner publishing discounted listings and opportunities on the Platform. 1.5. “Listing”: discounted opportunity listing published by a seller on the Platform. 1.6. “User Content”: text, images, prices, locations and other information uploaded or transmitted by users or sellers. 2. NATURE OF THE PLATFORM – INFORMATION SERVICE ONLY 2.1. The Platform is a digital discovery and information tool that displays nearby discounted listings and opportunities on a map and in lists. 2.2. The Platform is not a food seller, restaurant, broker, commission agent, logistics provider, or delivery company, and is not a party to purchase contracts. 2.3. Payment, pickup, refunds, invoicing, food safety, hygiene, and consumer rights are handled solely between buyer and business, outside the Platform and beyond our control. 2.4. Prices, stock, distance, address, opening hours and similar data are supplied by sellers; we do not guarantee accuracy, completeness, or timeliness. 2.5. You are solely responsible for decisions you make based on Platform information. 3. SCOPE OF SERVICE 3.1. The Platform may offer discovery, contact details, favorites/alerts, and similar digital features. 3.2. The Platform does not provide payment processing, reservation guarantees, or stock reservation. 3.3. Features may be changed, suspended, or discontinued at our discretion. 4. ACCOUNTS AND SECURITY Seller accounts are created and accessed via email OTP. You are responsible for safeguarding access. Misleading or impersonation accounts are prohibited. Report suspected unauthorized access to support@merilinapp.com. 5. SELLER OBLIGATIONS Sellers are solely responsible for accurate, lawful listings and compliance with food safety, hygiene, labeling, pricing, and trade laws. Verification data must be truthful. Unverified or rejected businesses may be restricted. Sellers use the Platform only for lawful business activity. 6. BUYER RULES The Platform is informational; stock, prices, and offers may change instantly. Abuse, harassment, spam, and fraudulent reports are prohibited. Location and notification permissions are managed in device settings. Buyers should confirm listing details with the business before visiting or purchasing. 7. AGE AND ELIGIBILITY 7.1. The Platform is intended only for users aged 18 or older. 7.2. By using the service, you declare that you are at least 18 years old. 7.3. We do not perform separate identity or age verification; access relies on your declaration. 7.4. If underage use is reported or discovered, access will be terminated and related data deleted or anonymized. 8. NOTIFICATIONS Operational notifications may be required to provide the service. Marketing notifications are sent only with separate marketing consent and must not be bundled with core service acceptance. 9. INTELLECTUAL PROPERTY Platform software, design, and branding belong to the Service Provider. Unauthorized copying, reverse engineering, and commercial misuse are prohibited. Users retain rights in their User Content and grant the Platform a limited license to operate the service. 10. THIRD-PARTY SERVICES, ADS, AND EXTERNAL LINKS Maps, location, analytics, notifications, hosting, and ads may be provided by third parties. Ads belong to third parties; we are not responsible for ad content or advertiser commitments. External links in seller profiles are outside the Platform. Phone calls, messaging, payments, pickup, and physical visits outside the app are solely between you and the business. 11. DISCLAIMER AND LIMITATION OF LIABILITY 11.1. To the fullest extent permitted by mandatory law, the Platform is provided “as is” and “as available” without warranties of any kind (including merchantability, fitness for purpose, uninterrupted or error-free operation). 11.2. We accept no liability for listing content, prices, stock, food quality, food safety, allergens, hygiene, business conduct, disputes between users, breach of contract, or tort, except where mandatory law requires otherwise. 11.3. Location, map, distance, routing, and discovery results may be approximate; the Platform must not be used as a navigation or emergency tool. 11.4. To the fullest extent permitted by mandatory law, we are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, business interruption, or loss of reputation. 11.5. You agree to indemnify us against third-party claims arising from your use of the Platform or violation of these Terms, to the extent permitted by law. 11.6. We are not liable for interruptions due to force majeure (natural disasters, war, strikes, general internet outages, authority actions, third-party failures, etc.). 12. SUSPENSION AND TERMINATION We may suspend or terminate access or accounts without prior notice for violations, suspected fraud, legal requirements, or Platform security. 13. GOVERNING LAW Turkish law applies. Izmir (Central) courts and enforcement offices have jurisdiction, subject to mandatory consumer protection rules where applicable. 14. CHANGES We may update these Terms. Material changes will be announced in-app or by email. Continued use after updates constitutes acceptance. 15.
